1. ACCEPTANCE OF TERMS

1.1 By accessing or using our website comineyy.in ("Website"), creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.2 We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
* Definitions "Website" refers to comineyy.in and all its subdomains.
"User," "You," or "Your" refers to any individual or entity accessing or using the Website. "Products" refers to HOT WHEELS carded cars, JADA cars, Bburago Cars, Action figures, and Collectibles sold on the Website.
"Content" refers to text, images, videos, and other materials displayed on the Website.


2. INTELLECTUAL PROPERTY RIGHTS

2.1 Hot Wheels® is a registered trademark of Mattel, Inc. All Hot Wheels products sold on our Site are authentic Mattel merchandise. Our Site is not affiliated with, endorsed by, or sponsored by Mattel, Inc.
2.1 Bburago® is a registered trademark of Bburago International, Inc. All Bburago products sold on our Site are authentic Bburago merchandise. Our Site is not affiliated with, endorsed by, or sponsored by Bburago International, Inc.
2.1 Jada® is a registered trademark of Jada, Inc. All Jada products sold on our Site are authentic Jada merchandise. Our Site is not affiliated with, endorsed by, or sponsored by Jada, Inc.
2.2 All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of comineyy.in or its content suppliers and is protected by copyright and other intellectual property laws.
2.3 You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, or otherwise exploit any content without our prior written permission.


3. USER ACCOUNTS

3.1 To access certain features of our Site, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.3 We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete, or if you have violated these Terms.

4. PURCHASING POLICIES

4.1 Product Descriptions: We strive to provide accurate descriptions of all the collectibles. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free.

4.2 Card Condition: All Hot Wheels cars, Jada and Bburago cars are sold in their original packaging ("carded"). We use the following condition grades:

Near Mint (NM): Minor imperfections on card or bubble
Excellent (EX): Noticeable wear but still displayable
Good (G): Significant wear, creases, or damage
Note: No card is 100% mint.
Condition may change as per goods received after shipping.

4.3 Pricing and Availability: All prices are in INR unless otherwise specified. We reserve the right to change prices at any time without notice. Items in your cart are not reserved until payment is completed.

4.4 Limited Editions and Rare Items: For limited edition or rare Hot Wheels collectibles, we reserve the right to limit quantities per customer.


5. PAYMENT AND SHIPPING

5.1 Payment Methods: We accept major credit cards, debit cards, UPI and other payment methods as indicated at checkout.

5.2 Shipping: We ship all over India. Shipping costs for diecast and collectibles and estimated delivery times will be provided during checkout. We are not responsible for delays caused by shipping providers

5.3 Packaging: All collectibles will be carefully packaged to minimize the risk of damage during shipping. For premium or high-value collectibles, additional protective packaging will be used.


6. RETURNS AND REFUNDS

6.1 Inspection Period: You have 5 days from receipt of your order to inspect items and request a return.

6.2 Return Eligibility: Items must be in the same condition as received and in original packaging. We reserve the right to refuse returns if items show signs of handling beyond reasonable inspection.

6.3 Return Process: To initiate a return, please contact our customer service via WhatsApp or drop a mail with your order number and reason for return. You will receive return shipping instructions.

6.4 Refunds: Upon receipt and inspection of returned items, we will process your refund to the original payment method within 5-7 business days.


7. DISCLAIMERS AND LIMITATIONS OF LIABILITY

7.1 Website "As Is": The Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

7.2 Investment Value: We make no guarantees regarding the investment or resale value of any Diecast, any Action figure or any other collectibles purchased through our Site.

7.3 Authenticity: We strive to sell only authentic collectibles. If you believe you have received an inauthentic item, please contact us immediately.

7.4 Limitation of Liability: In no event shall comineyy.in be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products.

7.5 Maximum Liability: Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount paid by you for the product(s) giving rise to such claim.

8. PROHIBITED ACTIVITIES

You agree not to:

    • Use the Site for any illegal purpose
    • Attempt to gain unauthorized access to any portion of the Site
    • Use automated means to access the Site or collect content
    • Interfere with the proper working of the Site
    • Circumvent, disable, or interfere with security features of the Site

9. USER CONTENT

9.1 If you submit reviews, comments, or other content to our Site, you grant us a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, and display such content.

9.2 You represent and warrant that you own or control all rights to the content you submit and that it will not infringe upon or violate the rights of any third party.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

10.2 Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the laws of India


11. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.


12. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and comineyy.in regarding the use of the Site and supersede all prior agreements and understandings.
